Okay so i was at the mall 3 months ago or so and spa lady had a stand up for promotions, a woman stopped me trying to get me to sit down and sign up. I explained to her i wasnt working or have a job at the moment, im getting married in a few months and i wont have time to join the gym, the lady told me to just fill out the form take it with me, and WHENEVER i want, if choose to join or not is fine with them. I just wanted her to stop insisting so i filled the paper and took it, figured i wont join. I did NOT know it was a sealed deal and it was a contract i couldnt get out of, i had joined and didnt know about it, she scammed me. Now they sent collection agencies after me for $900 that i dont even have, and i wasnt even aware i joined anything from what she told me i could come to them whenever if i decide to join!!! The agencies wont do anything about it, what do i do to get out of this.
Hello Hun it looks like you were taken for a ride for sure. You must have signed something and given her a copy or she took a copy and gave you others either way I really can/should only give you advise from the Collection Agency Point of view. When any debt is sent to collections they by law have to mail you out a validation notice within a certain amount of time. It pretty much is your first notice from their office. Now you have 30days to dispute the charges which anyone can do and has the right to do. You can call and tell them you dispute it and they may note it but you must also send them something in writing (Before the first 30 days are up) listing and giving them your reasons as to why you feel you don t owe it and they have to look into it.Now this may still not help you as if you signed a contract and they have a copy of it and you were over 18 when you signed it they will in the end consider your dispute invalid and continue with collections however by law they now HAVE to at least mark the account disputed when or if they report it on your credit with the credit bureau s. Not every creditor reports though believe it or not.! If it has already been 30 days - the validation period - they do not have to except your dispute (your reason as to why you feel you do not owe it)as being a valid dispute since you did not respond to the 30 day validation period noticeHope this helps some and if you have any other questions involving collections let me know! You could go to small claims court; however, it sounds to me like you signed a contract, although you may not have been aware that s what it was. I hope they gave you a copy of it so you can look it over carefully.At the very least, I would complain to the Better Business Bureau.Were you 18 when you signed it? If not, it is not a legal contract.
They did the same thing to me many years ago, The woman flat out lied to me. I just threw the papers away and they finally gave up.You could speak to an attorney who gives free consultations. Maybe you could sue them.
You may have been able to void this contract right at the start but now it is unlikely. Have you talked to the BBB?
NO NO they forced under duress you told them YOU had no job so get after the prper agencies for consumer orotection your rights were violated they did not disclose the terams of what you signed so they broke the law they have to tell you what your signing first it s the Law !tell them to call off the collection agency or else the local consumers rights agency will close them down !I had this happen to my son and they got zero $ took one phone call !also THE BBB does not help you all they do is file reports of such cliams !also try your loacl attorney s general office or the acatual mall where they are located if they are still there ! sounds like it was stand in the aisle a kiosk that can be set up anywhere They pay fees to operate and they are under the policies of the mall where they operate YOU were forced under duress ! I don t know why you just didnt tell them to buzz off and run away somethings a lil fishy in your stry here why did you let them make you sit down ?YOU must have had some interest in thier spa or sumthing for them to get you to sit down even after sitting down you didnt have to sign anything just toss the papers back at them say no thanks maybe later !Anyway if what YOU say is true they broke the Law by not telling YOU what you werer signing DO not bother with the collection agaency next time they call say what was this alleged charge and tell them you never signed up for anything and that you will report them for frud if they call againDO NOT give into thier threats they cannot do anything to you if they say they are law firm tell them they are laying they are noting more than scum that try to get fees for pennies on the dollar 1All this stuff is in Kevin trudeaus book called DEBT CURES They Don t want YOU to Know about !
Wow, that lady really scammed you, didn t she? Unfortunately, since you signed the contract, you owe the debt. One thing you may want to try is to go back to the location where you signed up and speak to the manager. If they re unwilling to help you by reducing or eliminating what they say you owe, get creative. Get a bunch of friends together, and make signs that say, This Business Tries To Rip Off People or something like that, and protest outside the spa. If you get kicked off of their property, protest on the public sidewalk outside. If you do it long enough, they ll probably try to work out a settlement with you.
The Better Business Bureau isnt going to help at all. They basically only report on members that pay them. In other words, if spa lady isnt a paying member to the bureau...they wont help. I hate to see things like this happen, but people will take advantage of those that are unsuspecting. I know it sounds a bit outlandish, but your best recourse is to probably contact the State Attorney General. They investigate these sorts of things, and shut these people down if they have to. There could be more complaints on file about this particular Spa Lady.
