Can artists create contracts restricting resale of their work? -

What I mean is can they create agreements that their works cannot be resold, for example an oil paintings artist. Could he create an agreement restricting resale until after his death to allow him to control pricing while he is alive?

The transfer of ownership from one person to another an original work of art can not be restricted. The artist can and does own the copyright of all the works of art they create unless they waive it. So while a person can resell a work of art or enjoy it themselves they can not use it for any other purpose. BUT I suppose that if someone was willing to agree to such a silly thing in writing when spending money, they deserve to stuck with it.

In Canada it is the copyright act that an artist can use to stipulate how, when, where, why and how their intellectual property will be used.
