You can legally have him removed, BUT will have to compensate him the equivalent of his share of the business, be that immediately, or over a period of time.My STRONG advice is to get a divorce lawyer to handle this. You want to do this so when 10 yrs passes down the road and your business suddenly hits it big.. then he CANT come after you for more $$$...

I have Power of Attorney - Can I take my Husband off Business? -
My Husband is currently deployed for a year, I run the business, I have for the three years we ve had it. We have a lot of issues, one being he hasn t touched me in seven years, yes, I said seven years! Now I found out a girl employee has been sending him packages and emails, among other things. We ve talked about divorce and he told me that he wants to sell the business when we divorce. I left a high paying job and devote all my time to this business, if we sell the business, I would have to start from the ground up and the job market sucks. I have POA over all personal business while he is gone, can I take him off the business completely? If, I can take him off, will I still have to split the business profits or partnership with him if we divorce?
