Can I use a name thats already been used? -

I want to use the name Dolly Girl for a clothing online store... but the name has been already used for an Anna Sui fragrance. Is it illegal to use it for my shop, or is it okay since its a different kind?

Generally, it s okay as it s a different type of merchandise, and there s little danger that people can t tell the difference between a fragrance vs. a clothing store. It s when you try to make stuff look-alike and in the same type of merchandise that things starts to get nasty.

This is a great way to be put out of business real fast. There was a very small pet supply company, ran owned by 2 women, who created pet toys. They named one of their chew toys Louie Chewton. The people at Louie Vaton were not amused and brought a law suit against them. The legal battle alone can run into the millions. Even if you win, you still lose unless you have very deep pockets.
