You can not patent something that does not exist. You can t even copy-write the name if it does not pertain to something tangible.You are talking about an idea, and ideas are not subject to patient or copy-write laws.
If it s not patented, once the recipe is out there anybody can take it. So you don t want to share. Also, remember that taking a scent or cologne to a large company thinking they ll never figure out how to copy it is not real wise either. They have entire R D departments that do nothing but take apart scents all day. So, what you might want to do is get a patent on the product, a copyright on the label, and then start selling it small and work your way up. If you sell it to the right person, or gift it to the right person you may get a foot in the door with a cosmetics company, but they don t actively seek stuff from individuals.
Apply for a copyright, then shop it around. It s just like web squatters who register every single domain name they can think of and then hold you up to the wall when you have an idea that a certain domain name would be perfect for. However, copyrighting a trade name is not a slimy practice, like the one I just outlined.
