Is it legal for a business to keep tips? -

I ve been at this restaurant since it opened, and we have never received tips. We have a tip jar and a gratuity line on credit card slips, but none of the employees are receiving tips, and they are saying that it is to cover employee meals, where when we had first started they said meals were free. now my question is this... is this legal? i mean, i feel like we re stealing from the customer, since they think they re giving it to the people serving them.

You are not making min wage and not getting your tips. I believe that you can report them to your state employee dept. You either make min wage or you make less plus tips.Either way you should be looking for another job as they are playing you for a sucker and you are letting them get away with it.

Not sure what state you live in but in California it is against the law. Though you should inquire about whistleblower laws in your state on the same token. Whistleblower - those who report on others/businesses for illegal activity.

no its not legal because the tips are not income for the restaurant. i would report it to equal employee rights group or something. i forgot what its called

Please report these scum bags to the state. Yes, the tips are rightfully yours. Document the receipts, and quit ASAP. You deserve better.

get rid of the tip jar if it doesn t benefit you.
