Can a restuarant make you work kitchen duties for 2.13 an hour before it even opens? -

The restuarant that I currently work at is trying to cut labor cost and has cut down on the hours of the kitchen preparation workers, there for the waiters have to make up for all the work that need to be done, we go in an hour before the restaurant opens and work setting up the whoe restaurant but still get paid the 2.13 wage for that hour , where we cant make tips... is that even legal?

no - they have to pay you regular min wage and in any case - they have to pay you min wage INCLUDING tips so if you don;t make enough in tips to make at least min wage for ALL those 2.13/hr hours - they have to make up the difference - that s the law
