Sara it really depends on the terms that the deposit was made. Eg. if it was like a lay-by term then you can fight it and the hassle will probably allow him to just give it to you for price promised, but unfortunately a deposit is just that, a deposit, so long as he gives back the deposit he is not entitled to go through with the sale if he chooses not to.
